Welcome to The Lemonade Stand Co. (“TLS,” “we,” “us,” or “our”). These Terms & Conditions govern your use of the TLS website, online marketplace, services, and any related programs or activities.
By accessing or using our website, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, please do not use the website or our services.
The Lemonade Stand Co. is a not-for-profit organization created to empower young people by encouraging creativity, entrepreneurship, confidence, independence, and hands-on learning.
TLS provides a platform through which participating young entrepreneurs may showcase and, where applicable, offer their handmade products, artwork, crafts, or other approved items for sale within the TLS community.
TLS may also work with community organizations, programs, families, volunteers, and other partners to support youth entrepreneurship and community engagement.
TLS is intended to support young entrepreneurs, including children and youth who may be under the age of majority.
Individuals under the age of majority may only participate in TLS programs or sell products through the platform with the involvement and consent of a parent or legal guardian.
By registering a child or youth for a TLS program or marketplace, the parent or legal guardian confirms that:
They have the legal authority to provide consent on behalf of the participant.
The information provided to TLS is accurate and complete.
They understand and accept these Terms & Conditions on behalf of the participant.
They are responsible for supervising the participant’s use of the platform and participation in any sales or activities.
They understand that TLS is intended to provide an educational and entrepreneurial experience and does not guarantee that a participant will make sales or earn income.
TLS reserves the right to request confirmation of parental or guardian consent at any time.
Participants may be permitted to create or operate an online store or profile through TLS.
For privacy and safety purposes, participants should not be required to publicly display their full legal name. Participants may use an approved business or store name instead.
Examples may include a store name such as “Krazy Krafts” rather than displaying the participant’s full name.
TLS may review, approve, modify, suspend, or remove an account, store, listing, or content if we believe it does not comply with these Terms & Conditions or our safety standards.
Parents or guardians are responsible for supervising account activity associated with their child.
Participants may only offer products that are permitted by TLS.
Products may include handmade crafts, artwork, jewelry, creative projects, or other items approved by TLS.
TLS reserves the right to prohibit products that are:
Unsafe or potentially hazardous;
Illegal;
Misleading or fraudulent;
Inappropriate for children or youth;
Copyrighted or trademarked without appropriate authorization;
Food or consumable products where required approvals, permits, or safety requirements have not been met;
Dangerous, regulated, or restricted products; or
Otherwise inconsistent with the purpose or values of TLS.
TLS may remove any listing at its discretion.
Participants and their parents or guardians are responsible for ensuring that products offered for sale are accurately described, appropriately priced, safe, and suitable for sale.
TLS does not manufacture, inspect, guarantee, or independently certify every product listed by participants.
TLS is not responsible for defects, inaccuracies, allergies, injuries, losses, or damages arising from a product sold by a participant, except where liability cannot legally be excluded.
Parents and guardians are responsible for ensuring that their child complies with applicable laws and safety requirements relating to the creation and sale of products.
When you purchase an item through TLS, you agree to provide accurate information required to complete the transaction.
The seller is responsible for fulfilling the order in accordance with the applicable order details.
TLS may establish procedures regarding order processing, pickup, delivery, exchanges, or other methods of transferring products.
Specific arrangements may vary depending on the TLS program or participating community.
Any applicable prices, fees, payment terms, or transaction arrangements will be communicated through the website or applicable program information.
TLS is a not-for-profit organization and may use funds received through its programs to support its mission, operating costs, youth programming, community initiatives, or other purposes consistent with its organizational objectives.
TLS will clearly communicate any applicable fees or deductions before a participant or customer completes a transaction.
Because products may be handmade and created by individual young entrepreneurs, All transactions are final as our mission is for fundraising purposes.
Where products are exchanged through a community, school, organization, or other designated location, TLS may establish specific pickup dates, times, and procedures.
Parents or guardians may be required to collect products on behalf of participating youth.
TLS is not responsible for delays or failures caused by circumstances outside its reasonable control.
Users and participants may have the opportunity to submit photographs, product descriptions, artwork, business names, logos, videos, or other content to TLS.
By submitting content, you confirm that you have the necessary rights and permissions to provide that content to TLS.
You retain ownership of your original content.
However, by submitting content to TLS, you grant TLS permission to use, reproduce, display, and share the content for purposes reasonably related to operating, promoting, and communicating about TLS and its programs, subject to applicable privacy requirements and any separate consent that may be required.
TLS will make reasonable efforts to protect the privacy of participating children and youth and may use store names rather than children’s legal names in public-facing materials.
TLS takes privacy and safety seriously.
Personal information will be collected, used, and disclosed in accordance with TLS’s Privacy Policy and applicable privacy laws.
Participants and families should not publicly share sensitive personal information, including home addresses, personal telephone numbers, passwords, or other information that could compromise their privacy or safety.
TLS may remove content or suspend accounts where we believe there is a privacy or safety concern.
The TLS name, logo, branding, website design, text, graphics, photographs, trademarks, and other materials created by or for TLS are owned by TLS or used with permission and may not be copied, reproduced, modified, or distributed without prior written permission.
Participants retain ownership of their original creative work unless otherwise agreed in writing.
Users may not use the TLS website or services to:
Violate any applicable law;
Impersonate another person;
Provide false or misleading information;
Attempt to gain unauthorized access to another account;
Upload malicious software or harmful material;
Sell prohibited or unsafe products;
Infringe another person’s intellectual property rights;
Harass, threaten, bully, or discriminate against another person;
Collect personal information from children or other users without authorization; or
Use TLS for purposes inconsistent with its mission or these Terms & Conditions.
TLS may use third-party service providers to support website hosting, payment processing, communication, technology, delivery, or other services.
Third-party services may have their own terms and privacy policies. TLS is not responsible for the policies or practices of third-party providers except where required by law.
We make reasonable efforts to keep the TLS website available and functioning; however, we do not guarantee that the website will always be available, uninterrupted, secure, or error-free.
TLS may modify, suspend, or discontinue any part of the website or services at any time.
TLS provides its website and services on an “as available” basis.
To the extent permitted by law, TLS does not guarantee that:
Products will sell;
Participants will earn a particular amount of money;
The website will always be available;
Listings will receive customer interest;
Products will meet every customer’s expectations; or
The platform will be completely free from errors or interruptions.
Participation in TLS is intended to provide an educational and entrepreneurial experience and does not constitute a promise of employment, income, or business success.
To the maximum extent permitted by applicable law, TLS and its directors, officers, employees, volunteers, representatives, and service providers will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of the website or participation in TLS programs.
Nothing in these Terms & Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.
Where The Lemonade Stand Co. operates or facilitates a program in partnership with, or on the premises of, a school, school board, community organization, or other participating organization (collectively, a “Participating Organization”), the Participating Organization’s involvement does not make it the operator, seller, manufacturer, or administrator of TLS or of any products offered through the TLS platform.
Unless expressly agreed to in writing:
TLS is solely responsible for the operation and administration of its platform and programs.
TLS is responsible for establishing its program requirements, participant guidelines, and marketplace procedures.
Participating Organizations do not endorse, guarantee, inspect, manufacture, or assume responsibility for products offered through TLS.
Participating Organizations are not responsible for transactions between buyers and sellers.
Participating Organizations are not responsible for the quality, safety, legality, accuracy, or condition of products offered through TLS.
Participating Organizations are not responsible for any loss, damage, injury, claim, dispute, refund, return, or other matter arising from a product, transaction, participant activity, or use of the TLS platform, except to the extent that such liability cannot legally be excluded.
Parents and guardians remain responsible for their child’s participation, supervision, consent, and compliance with applicable TLS requirements.
TLS does not make any representation that a Participating Organization is sponsoring, endorsing, or guaranteeing the activities of TLS unless expressly stated in a written agreement.
A Participating Organization may establish additional rules, safety requirements, supervision requirements, or restrictions applicable to activities taking place on its premises. Those requirements must be followed by all TLS participants.
To the maximum extent permitted by law, participants and their parents or legal guardians agree to release and hold harmless Participating Organizations, including their trustees, directors, officers, employees, teachers, administrators, volunteers, agents, and representatives, from claims, losses, damages, liabilities, costs, or expenses arising from or relating to:
participation in TLS programs;
the creation, sale, purchase, pickup, delivery, or exchange of products;
the condition, quality, safety, or use of products;
interactions between participants, customers, parents, guardians, volunteers, or other users;
use of the TLS website or platform; or
any act or omission of TLS, a participant, parent, guardian, seller, buyer, or other third party,
except to the extent that such release or indemnification is prohibited by applicable law or arises from the Participating Organization’s own negligence or other legally actionable conduct.
Nothing in these Terms & Conditions is intended to transfer responsibility for a matter that is legally required to remain with a school, school board, or other Participating Organization.
Where required, TLS may enter into a separate written agreement with a school, school board, or Participating Organization establishing the respective responsibilities, insurance requirements, supervision arrangements, privacy obligations, and risk-management procedures for the program.
To the extent permitted by law, users and participating parents or guardians agree to indemnify and hold harmless TLS, its directors, officers, employees, volunteers, and representatives from claims, losses, liabilities, damages, and expenses arising from their violation of these Terms & Conditions, unlawful conduct, or misuse of the TLS platform.
TLS may suspend or terminate access to the website, an account, online store, listing, or program where we reasonably believe that these Terms & Conditions have been violated or where suspension or termination is necessary to protect the safety, privacy, or integrity of the TLS community.
TLS may update these Terms & Conditions from time to time.
Any changes will be posted on this page with an updated “Last Updated” date.
Your continued use of the website after changes are posted constitutes acceptance of the updated Terms & Conditions.
These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada.
Any dispute arising from these Terms & Conditions will be subject to the applicable courts of Ontario, unless otherwise required by law.
